Terms & Conditions

The legal terms governing your use of PAS CU PAS.

Terms & Conditions

SART CREATIVE TRADING SRL · Draft — not yet in effect

Acceptance of These Terms

These Terms & Conditions ("Terms") govern your access to and use of the PAS CU PAS Android app (the "Platform Android app") and the PAS CU PAS website (the "Platform website"), together referred to as the "Platform", operated by SART CREATIVE TRADING SRL, registered at Str. Maramures 65A, Camera 2, Botosani, 710360, Romania ("PAS CU PAS," "we," "us," or "our").

References in these Terms to the Platform apply to both the Platform website and the Platform Android app. Where a rule applies to only one of them, these Terms say so expressly, and an action described as available on one is not available on the other unless these Terms say so.

By creating an account or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.

Where these Terms describe how Challenge Levels, Badges, Streaks, Pas cu Pas Shields, the Pas cu Pas Wallet, Prize Pools, or Contribution Weight work, the Official Pas cu Pas Handbook is the authoritative explanation of how those mechanics operate. The Terms and the Handbook are to be read together and interpreted consistently. If they appear to conflict about how a mechanic operates, the explanation of the mechanic in the Handbook applies, and these Terms govern the legal relationship between you and PAS CU PAS. In every case, mandatory law prevails: the Handbook cannot override your statutory rights or other mandatory applicable law, and it cannot change the price, requirements, or entitlements that apply to a Challenge you have already purchased (see Sections 6 and 23).

Description of the Platform

PAS CU PAS is a commitment platform. Each month, you select a Challenge Level and commit to completing a set number of walking or running sessions, each meeting a minimum step requirement, before the end of the month. PAS CU PAS verifies completed sessions, tracks your progress, and applies the rules described in the Official Pas cu Pas Handbook to determine your streak, Badge, and Prize Pool outcomes.

The Platform has two interfaces with distinct functions. The Platform website is where all commercial and financial actions take place: registering and managing your account where applicable, purchasing and enrolling in a monthly Challenge and paying for it (including entering a referral code at checkout), viewing and managing your Wallets, viewing referral programme information and any applicable referral rewards, purchasing Shields with Referral Wallet balance, requesting withdrawals of eligible withdrawable balances, and reviewing your financial transaction history and payment records. The Platform Android app is a performance tracker: it tracks your walking and running sessions, verifies them and synchronizes them with our servers, and shows your Challenge Level, status, targets and progress, your session history, statistics, Badges and Streaks, and your Shield status and earned Shields. It also displays, for information only, your Commitment Wallet, Prize Wallet, and Referral Wallet balances and information about available rewards and your account status.

You cannot purchase a Challenge, enter a referral code, make a payment, request a withdrawal, purchase a Shield, redeem a referral reward, or carry out any other financial or commercial action in the Platform Android app. These actions are available only on the Platform website.

These Terms describe the Platform as it operates when its features are available. A feature described in these Terms applies to you only from the time it is made available on the Platform.

As of this version of the Platform ("PAS CU PAS v1.0"), the only supported activities are walking and running. Future versions may introduce additional activities or features; such changes will be reflected in an updated Handbook and, where they affect your legal rights, in updated Terms.

PAS CU PAS does not provide fitness, medical, nutritional, or financial advice. See Disclaimers below.

Eligibility

To use the Platform, you must be at least 18 years old.

By creating a PAS CU PAS account, you confirm that you meet this age requirement, that you are able to form a legally binding contract, and that you are not barred from using the Platform under applicable law or a prior suspension by PAS CU PAS.

You may hold only one PAS CU PAS account. Creating or operating multiple accounts to increase your Prize Pool share, evade a suspension, or otherwise circumvent these Terms is prohibited (see Fraud Review & Suspension).

User Accounts

  • Providing accurate registration information and keeping it up to date;
  • Maintaining the confidentiality of your login credentials;
  • All activity that occurs under your account.

Notify us immediately at support@pascupas.app if you suspect unauthorized use of your account.

Monthly Enrollment

You may only purchase the current calendar month's PAS CU PAS Challenge. A purchase never applies to future months, and PAS CU PAS does not make automatic recurring charges for future Challenges.

Challenges are purchased and enrolled in on the Platform website. A Challenge cannot be purchased in the Platform Android app.

Enrollment for each month closes at 23:59 (Official Pas cu Pas Server Time) on the 25th day of that month. If you have not enrolled by then, you must wait until the 1st day of the following month to join the next Challenge.

The moment you complete your purchase, that month's Challenge begins immediately for you. This does not affect any mandatory consumer right of withdrawal or cancellation.

Challenge Levels & Monthly Commitments

Every month, you choose one of the available Challenge Levels (Path, Trail, Climb, Ascent, Summit, or Peak). Your Challenge Level determines:

  • The number of sessions required that month;
  • The minimum steps required per session;
  • Which Prize Pools you are eligible to participate in;
  • Your Contribution Weight within any Prize Pool you qualify for.

You may choose a different Challenge Level each month. Changing your Challenge Level does not affect your existing streak, Badge, or prior achievements. Full details, including current pricing and Contribution Weight tables, are published in the Official Pas cu Pas Handbook and are subject to change for future Challenges on reasonable notice. A change does not alter the price, requirements, or entitlements of a Challenge you have already purchased, except where the change is required by law or is otherwise lawfully agreed with you.

A session only counts toward your monthly commitment if it is completed outdoors, meets your Challenge Level's minimum step requirement, is verified by PAS CU PAS, and is completed before the end of the monthly challenge, as described in the Handbook.

Session Verification & Location Data

To verify that a session was completed outdoors and meets your Challenge Level's requirements, the Platform Android app requires access to your device's location services during tracked sessions. If you do not grant the required permission, you will not be able to complete a verifiable session.

The specific technical method PAS CU PAS uses to verify sessions is part of the Platform Android app’s internal functionality and is not detailed in these Terms. Our collection and use of location data is described in the Privacy Policy.

Challenge Purchases, Platform Fees & Commitment Deposits

Each Challenge Level has its own monthly purchase price, consisting of two parts:

  • Platform Fee — grants access to PAS CU PAS and supports the operation and development of the Platform. The Platform Fee is non-refundable except where a refund or withdrawal is required by applicable law or expressly provided for in these Terms.
  • Commitment Deposit — your personal financial commitment to completing the Challenge you selected. It is refunded in full to your Commitment Wallet if you successfully complete your monthly challenge, or if a Pas cu Pas Shield is consumed to protect your month. It is forfeited if you fail your monthly challenge without an available Pas cu Pas Shield.

Together, the Platform Fee and Commitment Deposit make up the Total Cost for your selected Challenge Level. Current pricing is published on the Pricing page and in the Official Pas cu Pas Handbook.

Monthly Settlement & Billing

PAS CU PAS does not use automatic recurring billing. You purchase each monthly Challenge manually, and no charge is made for a future month unless you purchase that month's Challenge. By purchasing a Challenge on the Platform website, you authorize PAS CU PAS and our payment provider, Stripe, to charge your selected payment method for the Total Cost of the Challenge Level you chose.

Monthly settlement takes place on the 1st day of every month, at Official Pas cu Pas Server Time. During settlement, PAS CU PAS automatically processes Commitment Deposit refunds, Bronze Rewards, Silver/Gold/Elite Prize Pool distributions, Pas cu Pas Shield processing, and Wallet credits, as described in the Official Pas cu Pas Handbook.

Cancelling a Challenge

PAS CU PAS does not use automatic recurring billing, so there is no subscription to cancel. A Challenge you have purchased is a commitment for that month. You cannot cancel it simply by ceasing to use the Platform or by deciding not to complete the required sessions.

Once a monthly Challenge has started:

  • The Platform Fee remains non-refundable, subject to the exception in Section 8;
  • Your Commitment Deposit remains governed by the outcome of that month's Challenge;
  • Ceasing to use the Platform does not exempt you from the Challenge;
  • If the Challenge is not completed successfully, your Commitment Deposit is forfeited under the same rules as for any other failed Challenge.

Prize Pools & Contribution Weight

Reaching certain streak milestones makes you eligible to participate in PAS CU PAS's Prize Pools, funded from a portion of PAS CU PAS's monthly profit as described in the Handbook. Within each Prize Pool, your share is not equal among participants: it is sized according to the Contribution Weight assigned to your selected Challenge Level, reflecting the greater commitment required at higher levels.

Contribution Weight only affects the size of a Prize Pool reward. It has no effect on your Badge, your streak, or your eligibility for a Prize Pool, which are determined independently under the rules in the Handbook.

Prize Pool participation is not an investment, a lottery, or a guarantee of payment. Rewards are only paid according to the rules published in the Handbook at the time they are earned, and are contingent on PAS CU PAS's actual monthly profit and the number of eligible participants.

Badges & Streaks

Badges (Bronze, Silver, Gold, Elite) and streaks are earned and adjusted automatically according to the rules in the Official Pas cu Pas Handbook. Your highest Badge ever achieved remains visible on your profile even if your current Badge is later reduced.

Pas cu Pas Shields

A Pas cu Pas Shield is automatically consumed, with no action required from you, if a monthly challenge would otherwise fail while a Shield is available. When a Shield is consumed:

  • Your streak, Badge, and selected Challenge Level are preserved;
  • Your qualification for future Prize Pools is preserved;
  • Your Commitment Deposit is refunded to your Commitment Wallet during Monthly Settlement;
  • You do not receive a Prize Pool reward for the month in which the Shield was consumed.

A Shield protects your progress. It does not replace a completed commitment. Only one Shield can be consumed per failed month. Shields are earned and limited as described in the Handbook (one Shield at Silver Badge, one at Elite Badge, one additional purchasable Shield per calendar year, maximum two active Shields at any time).

The additional Shield that may be purchased each calendar year can be purchased only on the Platform website, and only with Referral Wallet balance (see Section 14). No cash payment, card payment, Stripe checkout, or other payment method is offered for Shields, and Commitment Wallet and Prize Wallet balances cannot be used to purchase Shields. A Shield is granted only if the purchase is completed successfully. Referral Wallet balance comes from the referral programme, which is being prepared for launch and is not yet operational. Shields cannot be purchased in the Platform Android app, which displays Shield status for information only.

Pas cu Pas Wallet

The Pas cu Pas Wallet is made up of three separate balances, each with its own purpose and rules. Each balance is recorded separately, and funds cannot be transferred from one Wallet to another.

  • Commitment Wallet — displays only the amount you have actually received back and currently hold as available funds. It does not show a Commitment Deposit you have paid as though it had already been returned. Commitment Deposits you have paid, and deposits held during a Challenge, are recorded separately by PAS CU PAS and are returned or forfeited under Sections 8, 10, and 13. Available Commitment Wallet funds can be withdrawn and used to purchase future Challenges, in each case through the Platform website; Commitment Deposits still held for an active Challenge are not available for withdrawal or spending;
  • Prize Wallet — holds the cash rewards you earn: eligible Bronze Rewards and Silver, Gold, and Elite Prize Pool rewards. Eligible Prize Wallet balances can be withdrawn through the Platform website, subject to the withdrawal process below and to Section 17. Prize Wallet funds cannot be used to purchase Challenges or Shields;
  • Referral Wallet — holds rewards earned through the referral programme. It is not cash: Referral Wallet funds cannot be withdrawn, transferred to the Commitment Wallet or Prize Wallet, converted into cash, or used to purchase Challenges. Referral Wallet funds can be used only to purchase eligible Shields on the Platform website.

A referral code can be entered only when purchasing a Challenge on the Platform website; it cannot be entered in the Platform Android app. The referral programme and the Referral Wallet are not yet available. When the programme launches, referral eligibility, attribution, qualifying events, abuse prevention, reward crediting, and reversals will be governed by the referral programme rules published at that time.

All Wallet actions are carried out on the Platform website. The Platform Android app displays your Commitment Wallet, Prize Wallet, and Referral Wallet balances for information only; no financial or commercial action can be taken there.

Commitment Wallet funds may be used to purchase future monthly enrollments once enrollment for those months becomes available. Wallets cannot be topped up: Wallet balances are credited only as described in this Section.

Withdrawals

Withdrawals are requested and managed on the Platform website. They cannot be requested, approved, or managed in the Platform Android app. Only eligible withdrawable balances can be withdrawn: available Commitment Wallet funds and eligible Prize Wallet funds. Commitment Deposits still held for an active Challenge cannot be withdrawn, and Referral Wallet funds cannot be withdrawn. Withdrawal requests require approval by the PAS CU PAS team. The process is:

  • You submit a withdrawal request through the Platform website;
  • The PAS CU PAS team reviews the request and approves or rejects it;
  • Following approval, we obtain the payment details needed from you;
  • SART CREATIVE TRADING SRL pays the approved amount directly from its company bank account, as soon as reasonably possible once approved;
  • The transaction and its status are recorded and made available to you.

Wallet History

Every financial transaction related to your Wallets — including Challenge purchases, Commitment Deposit refunds, Bronze Rewards, Silver/Gold/Elite Prize Pool rewards, referral rewards, Shield purchases using Referral Wallet balance, and withdrawals — is permanently recorded and available in your account on the Platform website at any time.

Payment Provider

Payments made on the Platform website for Challenge purchases are processed by Stripe. PAS CU PAS does not store the full card or bank account details you use to pay through Stripe; such information is handled directly by Stripe in accordance with its own terms and applicable payment card industry standards. Payment details you give us for an approved withdrawal are separate and are described in the Privacy Policy. Shields are not paid for through Stripe or any other payment provider; they are purchased only with Referral Wallet balance (see Section 14).

Refunds

Refunds and forfeitures of your Commitment Deposit are governed by the rules above, the Official Pas cu Pas Handbook, and the dedicated Refund Policy, which sets out the refund process in more detail.

Nothing in this Section or in the Refund Policy affects any mandatory consumer rights you have, including any right of withdrawal or cancellation that applies to you by law.

Fraud Review, Account Suspension & Prohibited Conduct

PAS CU PAS reserves the right to review your account if we detect suspicious activity, including but not limited to:

  • Falsifying or manipulating location or activity data to obtain a session verification you did not legitimately earn;
  • Creating or using multiple accounts to gain an unfair advantage in Badges, streaks, or Prize Pools;
  • Using automated tools, bots, or scripts to interact with the Platform;
  • Attempting to reverse-engineer, circumvent, or interfere with PAS CU PAS's verification systems.

A flag or the opening of a review starts an inquiry. It does not, by itself, establish that fraud has occurred.

If suspicious activity is detected, the following review process applies:

  • Monthly settlement for your account is temporarily paused;
  • Your account enters review;
  • You are contacted and may be asked to provide additional information;
  • You have 14 calendar days to respond;
  • The PAS CU PAS team reviews the evidence;
  • If fraud is not confirmed, settlement proceeds normally;
  • If fraud is confirmed, that month's Commitment Deposit and any Prize Pool reward for that month are forfeited, and your account is suspended;
  • If the requested information is not provided within 14 calendar days, the suspension becomes permanent (see Failure to respond below).

Where fraud is established

Where the review establishes fraud, PAS CU PAS may apply the sanctions provided by these Terms and the Handbook, which include:

  • permanent suspension or termination of your account;
  • forfeiture of the Commitment Deposit for each month affected by the fraud;
  • forfeiture or reversal of any Bronze Reward, Prize Pool reward, or other reward attributable to the fraud, including recovery of any such amount already credited to a Wallet or paid out;
  • reversal of Referral Wallet credits obtained fraudulently or improperly, under the referral programme rules; and
  • reversal of any other benefit obtained through the fraud.

These measures apply to the extent permitted by applicable law.

Fraud discovered later

Fraud may be discovered after a Challenge has been settled or after a reward has been credited, withdrawn, or used. Settlement, crediting, withdrawal, or use does not protect amounts or benefits obtained through fraud. PAS CU PAS may review earlier activity and apply the sanctions above to it, subject to applicable law.

Failure to respond

If you do not provide the requested information within 14 calendar days, your suspension becomes permanent. Not responding is not, by itself, a finding that fraud occurred or that any particular amount was obtained fraudulently. However, because the information requested relates to the activity under review, the Commitment Deposit and any Prize Pool reward for the month under review are forfeited in the same way as if fraud had been established for that month. Other balances are not forfeited merely because you did not respond.

Your Wallets

  • Commitment Wallet — funds already returned to your Commitment Wallet and available to you are not forfeited merely because your account has been flagged, placed under review, or permanently suspended for failure to respond. Where fraud is established, a refund obtained through the fraud may be reversed from the Wallet to which it was credited. Commitment Deposits still held for a Challenge are handled under the applicable Challenge rules and the outcome of the review;
  • Prize Wallet — rewards attributable to the fraud may be forfeited or reversed under this Section and the applicable rules;
  • Referral Wallet — Referral Wallet credits obtained fraudulently or improperly may be reversed under the referral programme rules.

Forfeiture and reversal apply to the amounts, rewards, and credits attributable to the fraud or to the matter under review. They do not apply automatically to every balance in every Wallet.

If you believe a decision under this Section is mistaken, you may contact us at support@pascupas.app and provide any relevant evidence. We will consider what you provide.

Account Deletion

You may request deletion of your account through the Platform Android app, through the account deletion request form on the Platform website, or by contacting support@pascupas.app. Submitting a request does not itself delete your account.

An account can only be deleted when all of the following are true:

  • Your Commitment Wallet and Prize Wallet balances are zero (Referral Wallet credit is not counted);
  • You have no active Challenge; and
  • You have no pending withdrawal.

An active Challenge is the Challenge Level you selected when you purchased your Challenge for the current month. A Challenge always ends at the end of the calendar month and is not active after that.

If any of these conditions is not met, you must first withdraw any remaining Commitment Wallet and Prize Wallet funds and complete or resolve all outstanding items before deletion can proceed. Deleting your account does not itself pay out or transfer a Wallet balance.

Once the conditions are met and your request is processed, your account enters a 30-day pending-deletion period. Account deletion requests are handled manually by our team. You can cancel a pending deletion by logging in to your account through either the Platform website or the Platform Android app during that period. If you do not log in during that period, your account and the account records covered by the deletion process, including session records and GPS routes, are removed at the end of the 30-day period, subject to applicable legal retention requirements.

Referral Wallet credit does not prevent you from deleting your account, but if your account deletion is completed, any Referral Wallet credit that remains is forfeited. It is not paid out or transferred. A deletion request that is cancelled, for example by logging in through the Platform website or the Platform Android app during the 30-day pending period, does not forfeit your Referral Wallet credit. We will tell you about this consequence before you confirm a deletion request.

Account deletion is separate from any suspension or termination arising from a Fraud Review, and the rules in Fraud Review, Account Suspension & Prohibited Conduct continue to apply. Further information about personal data is provided in the Privacy Policy.

Intellectual Property

The PAS CU PAS name, logo, Platform (including the Platform Android app and the Platform website), and all associated content, design, and software are the property of SART CREATIVE TRADING SRL or its licensors and are protected by applicable intellectual property laws. You retain ownership of the personal data and activity records you generate by using the Platform. By using the Platform, you grant PAS CU PAS a license to process that data as necessary to operate the Platform, as described in the Privacy Policy.

You use the Platform, and undertake any walking or running activity, at your own risk.

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. This does not affect your mandatory consumer rights, including any right to receive the service you purchased as contracted.

To the maximum extent permitted by applicable law, PAS CU PAS and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Platform.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury, for fraud or intentional misconduct, or any mandatory right you have as a consumer.

Indemnification

You agree to indemnify and hold harmless SART CREATIVE TRADING SRL from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Platform, to the extent permitted by applicable law. This obligation applies only to the extent permitted by applicable law. It does not require a consumer to indemnify PAS CU PAS for PAS CU PAS's own unlawful conduct or for liability that cannot lawfully be excluded.

Changes to the Platform and These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Platform Android app, the Platform website, or email before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law.

We may also modify, suspend, or discontinue any part of the Platform, including Challenge Levels, pricing, or Prize Pool structures, on reasonable notice, as reflected in an updated Handbook and Pricing page. These changes apply prospectively. They do not retroactively change the agreed price, requirements, or entitlements of a Challenge you have already purchased, except where a change is required by law or is otherwise lawfully agreed with you.

Disputes & Your Statutory Rights

Nothing in these Terms affects any mandatory rights you have as a consumer under the law of the country where you live.

If you have a complaint or a dispute, please contact us first at support@pascupas.app so that we can try to resolve it.

Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
